Privacy Policy
Effective date: October 26, 2026
This Privacy Policy explains how Tom Mawhinney Consulting Inc. ("we," "us," or "our") collects, uses, and shares information when you use the Targeting Excellence website and services (the "Service"). By using the Service, you agree to this policy.
1. Information we collect.
- Information you give us: name, email address, account credentials, and any information you enter (for example, in your profile or when you contact us).
- Payment information: processed by our payment provider. We do not store your full card number; the provider handles that and shares limited transaction details with us (for example, that a payment succeeded, the last four digits, and billing country).
- Usage information: how you interact with the Service, such as courses viewed, progress, device and browser type, IP address, and general location. Some of this is collected through cookies and similar technologies.
2. How we use information. To create and manage your account; to deliver the courses and features you purchase; to process payments and prevent fraud; to provide support; to improve the Service; to send you service-related messages and, where permitted, marketing you can opt out of; and to comply with legal obligations.
Marketing emails. We send marketing emails only with your consent, or where Canada's anti-spam law allows it (for example, for up to two years after you buy from us). Every marketing email identifies us and includes an unsubscribe link, and we act on unsubscribes within 10 business days.
3. Cookies and analytics. We and our providers use cookies and similar technologies to keep you logged in, remember preferences, and understand how the Service is used. You can control cookies through your browser settings; disabling some cookies may affect how the Service works.
4. How we share information. We do not sell your personal information. We share it only with:
- Service providers who run the Service for us (for example, our hosting/course platform, payment processor, email and analytics providers), under agreements that limit their use of it.
- Legal and safety recipients when required by law or to protect rights, safety, and property.
- Business transfers, if the business is involved in a merger, acquisition, or sale of assets.
5. Data retention. We keep personal information for as long as your account is active and as needed to provide the Service, then for as long as required to meet legal, tax, and accounting obligations, after which we delete or anonymize it.
6. Your rights. Depending on where you live, you may have the right to access, correct, delete, or receive a copy of your personal information, to object to or restrict certain processing, and to opt out of marketing. To exercise these rights, contact [email protected]. We will respond as required by applicable law. If you are in the EU or UK, we process your information to perform our contract with you, to meet legal obligations, for our legitimate interest in running and improving the Service, and with your consent for marketing, and you can complain to your local data protection authority. In Canada, you can contact the Office of the Information and Privacy Commissioner of Alberta or the Office of the Privacy Commissioner of Canada. You can unsubscribe from marketing emails using the link in any such email.
7. Security. We use reasonable technical and organizational measures to protect your information. No method of transmission or storage is completely secure, so we cannot guarantee absolute security. If a breach creates a real risk of significant harm to you, we will notify you and the relevant regulator as the law requires.
8. International transfers. We are based in Canada. Our main service providers store and process personal information in the United States: Kajabi (site, courses, accounts and email) and Stripe (payments), plus PayPal if you pay with it. They may use their own sub-processors in other countries, and they are allowed to use your information only to provide their services to us. You can ask our privacy contact (section 12) about these providers and how they handle your information. Where required, we use appropriate safeguards for these transfers.
9. Children. The Service is intended for adults and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact [email protected] and we will delete it.
10. Third-party links. The Service may link to third-party sites we do not control. Their privacy practices are their own; review their policies.
11. Changes to this policy. We may update this policy and will change the effective date above. Material changes will be communicated where appropriate.
12. Contact. Tom Mawhinney, Privacy Officer, is responsible for privacy at Tom Mawhinney Consulting Inc. and answers questions about how we and our service providers handle personal information.
